2. Service Description

Tuttu is a personal AI assistant that you reach by calling or texting a regular phone number. The service identifies you by your phone number, remembers previous conversations, and handles tasks you request. You can also manage the service through the web portal.

The service is provided "as is." The service provider continuously develops the service, and its features may change.

3. Eligibility and Registration

• You must be at least 18 years old to use the service. By registering, you confirm that you are at least 18.
• Access requires an invite code. Invite codes are non-transferable.
• Each user gets one account tied to their personal phone number.
• You are responsible for the security of your account, including keeping your PIN confidential.
• You may not share your account access with third parties.

4. Acceptance of Terms

You accept these terms when you start using the service. Acceptance occurs as follows depending on the channel:

• Call and SMS: By replying with your PIN to the service's message, you accept these terms.
• Web portal: By logging into the web service, you accept these terms.

The time of your acceptance is recorded on your account. If you do not accept these terms, do not use the service.

5. Payments and Billing

• The service operates on a credit system. Credits are used for calls, text messages, and other service features.
• Credit prices are listed on the service website. The service provider may change prices with at least 30 days' notice.
• Payments are processed through a third-party payment service (Stripe). We do not store payment card details.
• Right of withdrawal: Under EU consumer protection law, you have a 14-day right of withdrawal from the date of purchase. By using credits before the withdrawal period ends, you acknowledge that the right of withdrawal is waived for consumed credits. Unused credits may be refunded within the withdrawal period.
• After the withdrawal period, credits are non-refundable.

6. Acceptable Use

By using the service, you agree not to use it for the following purposes:

• Illegal activity: Using the service to plan criminal activity, harassment, fraud, or other unlawful conduct.
• AI abuse: Manipulating the AI to produce harmful content, attempting to extract system prompts, or circumventing safety limits.
• Infrastructure abuse: Automated calls or messages, overloading the service, or attempting to exploit the phone system.
• Account sharing: Sharing your PIN or phone number with others for the purpose of using the service.
• Commercial resale: Using the service to build your own product or service without a separate agreement.
• Harmful content: Using the service to produce content that harms others (defamation, threats, hate speech).

The service provider reserves the right to terminate an account immediately in cases of serious violations.

7. AI Limitations and Disclaimers

Tuttu is a useful tool but does not replace professional judgment. Please note the following limitations:

• Not professional advice: The AI is not a doctor, lawyer, financial advisor, or therapist. Do not make important decisions based solely on AI responses.
• Accuracy not guaranteed: The AI may produce incorrect, imprecise, or fabricated information (so-called hallucinations). Always independently verify important information.
• Memory reliability: Memories are stored as they appear in conversations. The AI may recall things incorrectly or imprecisely.
• Availability: The service may be temporarily unavailable due to technical issues, maintenance, or third-party service disruptions.
• Third-party AI models: The service uses AI models from external providers (OpenAI, Anthropic, Google, ElevenLabs), whose behavior may change without notice.

8. Intellectual Property

• You own all content you produce while using the service — including conversations, memories, and other data.
• You grant the service provider a limited license to process, store, and use your content solely for providing and improving the service. This covers AI processing, memory formation, summaries, and vector embeddings.
• The service provider does not sell your content to third parties or use it for advertising purposes.
• The service interface, software, and trademarks belong to the service provider.

9. Limitation of Liability

The service provider's liability is limited to the total amount paid by the user for the service during the preceding 12 months.

• The service provider is not liable for indirect damages, including lost revenue, lost opportunities, or loss of data.
• The service provider is not liable for damages resulting from incorrect information or advice given by the AI.
• The service provider is not liable for disruptions to third-party services.

Nothing in these terms limits the service provider's liability in cases where limitation of liability is not permitted under Finnish law — including intentional damage, gross negligence, and personal injury.

10. Service Availability

The service is provided as-is without any guarantees of uptime or availability. The service provider may modify, suspend, or discontinue the service or its features at any time.

11. Termination

Termination by user

You may terminate your account at any time by emailing [email protected] or by texting POISTA to the service number. After account deletion, your data is retained for 30 days, during which you may request a data export. After this period, all personal data is permanently deleted, except for records required for accounting and legal obligations.

Termination by service provider

• Serious violations: The service provider may close an account immediately for illegal activity, abuse, or other serious breach of terms.
• Other reasons: In other cases, the service provider will give at least 30 days' notice via SMS.

Data handling after termination

When the user terminates their account, data is retained for 30 days for data export purposes. When the service provider terminates for serious violations, data may be deleted immediately. In all cases, transaction records required by accounting law are retained for the statutory period.

12. Governing Law and Dispute Resolution

These terms are governed by Finnish law. Disputes shall be resolved primarily through negotiation.

Consumers have the right to refer disputes to the Finnish Consumer Disputes Board (kuluttajariita.fi). Proceedings before the Consumer Disputes Board are free of charge.

If a dispute cannot be resolved, it shall be settled in the Central Finland District Court (Keski-Suomen käräjäoikeus).

13. Changes to Terms

The service provider may update these terms as the service evolves. Changes are communicated as follows:

• Users receive an SMS notification of changes.
• Updated terms are published on this web page.
• New terms take effect 30 days after notification.

If you do not accept the updated terms, you may terminate your account before the new terms take effect. Continued use of the service after the new terms take effect constitutes acceptance.
